Regulations of the Abcros.pl online store

I. Definitions
The terms used in the Regulations mean:

1.1 Customer – a natural person, legal person or organizational unit that is not a legal person, the provisions of which specifically grant legal capacity, which places an Order within the Store;
1.2 Civil Code – the Act of April 23, 1964. (Journal of Laws No. 16, item 93, as amended);
1.3 Regulations – these Regulations for the provision of electronic services as part of the Abcros.pl online store;
1.4 Online Store (Store) – the website available at www.abcros.pl, through which the Customer may, in particular, place orders;
1.5 Goods – products presented in the Online Store;
1.6. Sales Agreement – a contract for the sale of Goods within the meaning of the Civil Code, concluded between MK Company Maciej Kusaj and the Customer, concluded using the Store’s website;
1.7 Consumer Rights Act – the Act of May 30, 2014. (Journal of Laws No. 2014, item 827);
1.8 Act on the provision of electronic services – the Act of 18 July 2002. on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended);
1.9 Order – Customer’s declaration of intent, aimed directly at the conclusion of the Sales Agreement, specifying in particular the type and quantity of goods;

II. General provisions

2.1 These Regulations define the rules for using the online store available at www.denley.pl;
2.2 These Regulations are the regulations referred to in Art. 8 of the Act on the provision of electronic services;
2.3 The Abcros.pl online store available at www.abcros.pl is run by MK Company Maciej Kusaj

2.4 These regulations specify in particular
a) the rules for registering and using the account as part of the online store;
b) the terms and conditions for submitting Orders by electronic means as part of the online store;
2.5 Using the online store is possible provided that the ICT system used by the customer meets the following minimum technical requirements:
a) web browsers, optional: Internet Explorer, Firefox, Mozilla, Google Chrome, Opera, Safari.
b) minimum screen resolution of 1024×768
c) Java Script
2.6 In order to use the online store, the Customer should, on his own, gain access to a computer station or terminal device with Internet access;
2.7 In accordance with applicable law, the operator of the Abcros.pl store reserves the right to limit the provision of services via the Online Store to persons under 18 years of age. In this case, potential customers will be notified of the above;
2.8 Customers can access these Regulations at any time via the link on the home page of www.abcros.pl and download it and print it out;
2.9 Information about the goods provided on the Store’s websites, in particular their descriptions, technical and performance parameters and prices, constitute an invitation to conclude a contract within the meaning of Article 71 of the Civil Code;

III. Rules for using the Online Store

3.1 The condition to start using the Online Store is registration therein;
3.2 Registration takes place by completing and accepting the registration form, available on one of the Store’s websites;
3.3 The condition for registration is to accept the Regulations and provide personal data marked with an asterisk as mandatory;
3.4 The administrator of the Store’s customer database is MK Company Maciej Kusaj with its registered office in Częstochowa at ul. Metallurgists 14F;
3.5 Accepting the regulations is tantamount to consenting to the processing of personal data provided in the registration form, in order to perform the sales contract and entrust them for processing to other entities with which the data controller has concluded a contract, in order to deliver the ordered goods to the extent necessary for its implementation;
3.6 Personal data of the Store’s customers are secured in accordance with the provisions of the Act of August 29, 1997. on the protection of personal data (i.e. Journal of Laws of 2015, item 2135 as amended), the Act of July 18, 2002. on the provision of electronic services (i.e. Journal of Laws of 2013, item 1422 as amended), the Regulation of the Minister of Internal Affairs and Administration of April 29, 2004. on personal data processing documentation and technical and organizational conditions to be met by devices and IT systems used to process personal data (Journal of Laws No. 100, item 1024);
3.7 With the separate consent of the Buyer, the personal data provided may be used for a different purpose within the scope indicated in the consent;
3.8 Customers of the Store through the website www.denley.pl have the right to access and correct the information provided by them which constitute personal data within the meaning of the Act of August 29, 1997. on the protection of personal data (i.e. Journal of Laws of 2015, item 2135, as amended), and in addition, they have the right to control the processing of their personal data and the right to submit, in the cases specified in this Act, in writing, a justified request to cease data processing due to a special situation and the right to object to the processing of his data in the cases specified in the Act;
3.9 During registration or at a later time, the customer may consent by checking the box [] “I want to receive the e-mail newsletter” and / or “I want to receive the SMS newsletter” to send him commercial information by electronic means, which is tantamount to consent to the processing of data personal data by MK Company Maciej Kusaj based in Częstochowa at ul. Hutników 14F, in order to implement direct marketing of own products. The consent in question may be canceled at any time;
3.10 MK Company Maciej Kusaj may deprive the Customer of the right to use the Online Store, as well as limit his access to some or all of the Online Store’s resources, with immediate effect, in the event of a breach by the Customer of the Regulations, in particular when the Customer:
a) during registration in the online store, he provided untrue, inaccurate or out-of-date data, misleading or infringing the rights of third parties;
b) committed, through the online store, infringement of personal rights of third parties, in particular the personal rights of other customers of the online store;
c) has committed other behaviors that will be considered by MK Company Maciej Kusaj as behavior inconsistent with applicable law or general principles of using the Internet or detrimental to the good name of MK Company Maciej Kusaj;
3.11 A person who has been deprived of the right to use the online store may not re-register without the prior consent of MK Company Maciej Kusaj.
3.12 The customer is obliged in particular to:
a) not to provide or transmit content prohibited by law, e.g. content that promotes violence, is defamatory or violates personal rights and other rights of third parties;
b) use the Online Store in a way that does not interfere with its functioning, in particular through the use of specific software or devices;
c) not taking actions such as: sending or posting unsolicited commercial information (spam) within the online store;
d) use the Online Store in a way that is not inconvenient for other customers and for MK Company Maciej Kusaj;
e) to use any content contained in the online store only for personal use;
f) use the online store in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as the general principles of using the Internet;

IV. The procedure for concluding a sales contract and order fulfillment

4.1 In order to conclude a Sales Agreement via the Online Store, go to the website www.abcros.pl, select the product, its brand, color and size, taking further technical steps based on the messages displayed to the customer and information available on the website;
4.2 The selection of the ordered Goods by the Customer is made by adding them to the basket;
4.3 When placing the Order – until the button “Buy and pay” is pressed – the Customer may modify the entered data and the selection of the Goods. To do this, follow the messages displayed to the Customer and the information available on the website;
4.4 After the Customer using the Online Store provides all the necessary data, a summary of the order will be displayed. The summary of the order placed will contain information on:
a) the subject of the contract,
b) unit and total price of the ordered products and delivery costs,
c) selected payment method,
d) the chosen method of delivery,
e) delivery time
4.5 In order to send the Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory and press the “Order, to pay” button;
4.6 Sending the Order by the Customer is a declaration of will to conclude a Sales Agreement with MK Company Maciej Kusaj, in accordance with the Regulations;
4.7. The sales contract is concluded in Polish, with the content in accordance with the Regulations.

V. Purchase of goods as part of an intra-community supply of goods within the EU for VAT payers identified for the purposes of intra-community transactions

5.1 When is the activity / transaction regarded as an intra-community supply of goods? The operation is considered an intra-Community supply of goods when the following conditions are jointly met:
a) the goods will be exported from the territory of the country, understood as the territory of the Republic of Poland, and takes place in order to perform the activities specified in art. 7 of the VAT Act in the territory of a Member State other than the territory of Poland;
b) the transaction was performed for a contractor who is a VAT taxpayer identified for the purposes of intra-Community transactions within the territory of the EU;
5.2 Who is the counterparty to intra-Community transactions?
The contractor is a VAT taxpayer identified for intra-Community transactions within the territory of the EU (i.e. has a valid EU VAT number) or is a legal or natural person not being a VAT payer who is identified for intra-Community transactions within the territory of the EU (i.e. has a valid EU VAT number) ;
5.3. In order to make intra-community delivery of goods in our store, please select “Company” in the ordering party’s data, select the destination country of delivery and select the option “I am an EU VAT payer. I am ordering without VAT and I undertake to settle it in my country”.
After positive verification of the contractor’s data, including the EU VAT number, we will issue you an invoice with 0 VAT rate in accordance with the regulations;

VI. delivery

6.1 The delivery of the Goods takes place to the countries listed on the website click to the address indicated by the customer when placing the order;
6.2 The delivery of the ordered goods takes place via the logistics operator “Paczkomaty InPost” and the courier company InPost only within the territory of the Republic of Poland. Delivery costs are described in detail on the website click . Outside Poland, the delivery is made via the InPost courier company;
6.3 The delivery period is 2 to 4 business days from the date of sending the Order by the Customer. The delivery of foreign shipments is from 7 to 10 business days;
6.4 Customers can access these Regulations at any time via the link on the home page of www.abcros.pl and download it and print it out.
Consolidation, security, disclosure and confirmation to the Customer of the essential provisions of the Contract for the Sale of Goods takes place by sending the Customer to the e-mail address provided and by attaching to the shipment, a fiscal receipt or a VAT invoice (at the Customer’s request);

VII. Prices and payment methods

7.1 The prices of the Goods are given in Polish zlotys and include all components, including VAT (including the rate), customs duties and any other components;
7.2 The customer can pay the price:
a) payment in the Przelewy24, Paypal system
b) payment with Pol Card, Visa, Mastercard payment cards. The credit card will be charged the day after the order is placed.
7.3 Orders with the option of cash on delivery (cash on delivery) may be placed only up to a maximum amount of PLN 1,000. Orders for amounts exceeding the threshold of PLN 1,000 are processed only with the option of prepayment

VIII. The right to withdraw from the contract

You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail).

You can use the model withdrawal form, but it is not obligatory. You can also complete and send the withdrawal form or any other unequivocal statement by e-mail to www.denley.pl. If they use this option, we will immediately send you a confirmation of receipt of the information on withdrawal from the contract on a durable medium (by e-mail).
In order to keep the deadline for withdrawing from the contract, it is enough for you to send information regarding the exercise of your right to withdraw from the contract before the deadline to withdraw from the contract.Consequences of withdrawal from the contract
In the event of withdrawal from this contract, we will refund all payments received from you, immediately, and in any case not later than 14 days from the date on which we were informed about your decision to exercise the right to withdraw from this contract. We may withhold the reimbursement until we receive the item or until proof of its return is provided to us, whichever occurs first.
Please send back or give us the item to the following address: MK Company Maciej Kusaj 42-202 Częstochowa Hutników 14F immediately, and in any case not later than 30 days from the date on which you informed us of your withdrawal from this contract. The deadline is met if you send back the goods before the period of 30 days has expired.
You will have to bear the direct cost of returning the goods. You can use one of the forms of return offered by us, courier, collected directly from the address provided by you or sending a return through the InPost parcel locker service. A fee of PLN 9 will be charged for using one of these return options (shipping cost + fixed handling fee). The amount that we will transfer to you for the returned products will be reduced by this value. Details and shipping instructions can be found on the website return.abcros.pl .

IX. Complaints about the Goods

9.1 MK Company Maciej Kusaj. as the seller is liable to the customer who is a consumer within the meaning of art. 22 1 Of the Civil Code, under the warranty for defects to the extent specified in the Civil Code;
9.2 Complaints arising from the violation of the Customer’s rights guaranteed by law or under these Regulations should be sent to the following address: kontakt@abcros.pl. MK Company Maciej Kusaj undertakes to consider each complaint within 14 days, and if it was not possible, to inform the Customer during this period when the complaint will be considered;
9.3 MK Company Maciej Kusaj is not a producer of goods. The manufacturer is liable under the warranty for the sold Goods under the conditions and for the period specified in the warranty card. If the warranty document provides for such a possibility, the Customer may submit his claims under the warranty directly to an authorized service center whose address is included in the warranty card;

X. Complaints regarding the provision of electronic services.

10.1 MK Company Maciej Kusaj takes steps to ensure that the Store operates correctly, to the extent that results from the current technical knowledge and undertakes to remove any irregularities reported by customers within a reasonable time;
10.2 The Customer is obliged to immediately notify MK Company Maciej Kusaj of any irregularities or interruptions in the functioning of the Online Store website;
10.3 Irregularities related to the functioning of the Store may be reported by the Customer in writing to the following address: MK Company Maciej Kusaj Hutników 14F 42-202 Częstochowa, by e-mail to the following address: kontakt@abcros.pl or using the contact form;
10.4 In the complaint, the Customer should provide his name and surname, correspondence address, type and date of irregularities related to the functioning of the Store;
10.5 MK Company Maciej Kusaj undertakes to consider each complaint within 14 days, and if it was not possible, to inform the Customer during this period when the complaint will be considered;

XI. Final Provisions

11.1 MK Company Maciej Kusaj is the owner of all product photos, graphics, logos and has full copyrights to them. MK Company Maciej Kusaj also has the appropriate licenses to use the photos used to create advertising banners. Copying, processing, sharing, publishing and using them for sale is prohibited and may result in criminal penalties. MK Company Maciej Kusaj does not allow their use, dissemination and distribution without the knowledge and written consent under pain of claims for infringement of copyright and committing theft of intellectual property;
11.2 Settlement of any disputes arising between MK Company Maciej Kusaj and the Customer who is a consumer within the meaning of Art. 22 1 Of the Civil Code, is subject to the competent courts in accordance with the relevant provisions of the Code of Civil Procedure
11.3 Settlement of any disputes arising between MK Company Maciej Kusaj running an online store and a customer who is not a consumer within the meaning of art. 22 1 Of the Civil Code, is subject to courts competent for the seat of MK Company Maciej Kusaj;
11.4 In matters not covered by these Regulations, the provisions of the Civil Code, the provisions of the Act on the provision of electronic services and other relevant provisions of Polish law shall apply;
